Khan Academy “Donor Giveaway” Official Contest Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

The Khan Academy Donor Giveaway Contest ("Contest") starts on December 10, 2018. All entries must be received by 11:59am Pacific Time ("PT") on December 14, 2018.

By participating, each entrant (and, if under 18, her/his parent or legal guardian) agrees to abide by these Official Rules and decisions of Khan Academy ("Sponsor"), which shall be final and binding in all respects relating to this Contest.
 
These “Official Rules” apply to the Khan Academy Donor Giveaway Contest.
 
1) CONTEST OVERVIEW: Khan Academy’s Donor Giveaway Contest rewards donations to Khan Academy with a chance to win a prize.
 
2) ELIGIBILITY: This Contest is open to individual legal residents of the United States aged 13 years of age or older as of the time of entry. A minor (under 18 years of age) must have her/his parent's or legal guardian's permission to enter. Employees of the Sponsor, and their families, agents and anyone else connected with this promotion are not eligible. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws.
 
3) HOW TO ENTER:
1. Donate to Khan Academy at khanacademy.org/donate, forward your donation receipt email to social@khanacademy.org and tell us how Khan Academy has helped you; or
2.  Send an email during the Contest Period to social@khanacademy.org with “Enter Me in the Khan Academy Donor Giveaway Contest” in the subject line, your name and email address in the body of the email, and tell us how Khan Academy has helped you.

Limit one (1) entry per day during the Contest Period. Entries received from any person in excess of this limitation will be void. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void.

By submitting an Entry, entrant (and, if under 18, her/his parent or legal guardian) represents and warrants that the Entry conforms to these Official Rules and understands that the Sponsor, in its sole discretion, may disqualify the Entry for any reason, including if it determines, in its sole discretion, the Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content.
 
5) WINNER SELECTION: All eligible Entries received by Sponsor during the Contest Period will be entered into the prize draw. One winner will be selected at random after 12pm PST each day from Monday December 10 through Friday December 14. Limit one prize per person.
 
6) WINNER NOTIFICATION: The potential winner will be notified by email on the day of the prize draw with a request to supply a mailing address within three (3) days of date of notification. Failure to respond within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by a potential winner will result in disqualification and, at Sponsor's sole discretion, the applicable runner-up may be notified.
 
7) PRIZES: Each winner will receive a shoutout on Khan Academy’s Instagram channel and 1 x JBL Clip 3 Portable Waterproof Wireless Bluetooth Speaker (ARV $49.95). Winner may not substitute, assign or transfer a prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. All prize details are at Sponsor's sole discretion.
 
8) USE OF ENTRIES: By participating, each entrant (and, if under 18, her/his parent or legal guardian) grants Sponsor and its designees, assigns, licensees and successors a perpetual, worldwide, royalty-free, irrevocable license to edit, modify, publish and distribute the Entry and all elements of such Entry, including, the entrant's name, city and state of residence and likeness (including, but not limited to, Instagram profile photo), for advertising, promotion and other purposes, in any and all media, now or hereafter devised, in any manner, in whole or in part, together with other materials, without additional compensation or notification to, or permission from, entrant, her/his parent or legal guardian or any third party.
 
9) PUBLICITY GRANT: By participating, each entrant (and, if under 18, her/his parent or legal guardian) agrees to the use by Sponsor and its designees of her/his name, city and state of residence, photograph (including, but not limited to, Instagram profile photo) and/or likeness and Entry, for advertising, promotional and other purposes, in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity, without compensation (unless prohibited by law) or additional consents from entrant, her/his parent or legal guardian or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.
 
10) RELEASE OF LIABILITY: By participating, each entrant (and, if under 18, her/his parent or legal guardian) agrees to release, discharge and hold harmless Sponsor, Instagram, LLC, and their respective parents, affiliates and subsidiaries, the Contest judges, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, "Released Parties") from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from student's participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize. Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, illegible, stolen, delayed, misdirected, undelivered, or garbled Entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, or in any Contest-related materials. Persons who tamper with or abuse any aspect of the Contest, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Contest be, in Sponsor's sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to suspend, modify or terminate the Contest and, if terminated, at its discretion, award the prizes from among all non-suspect, eligible entries received up to time of such action using the judging procedure outlined above or as otherwise deemed fair and appropriate by Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. All United States federal, state and local laws and regulations apply. Each entrant agrees to indemnify, defend and hold each of the Released Parties, harmless from and against any and all claims, actions, suits, proceedings and demands arising out of or relating to the use by any of them of the Photo as permitted hereunder, and all liabilities, losses, injuries and/or damages to entrant or any other person arising out of relating to the same. Entries will not be verified or returned. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of Khan Academy, which are final and binding in all respects. The Contest Entities are not responsible for any typographical or other error in the administration of the Contest or in the announcement of the prize. In no event will more than the stated number of prizes be awarded. By entering the Contest, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. Each entrant’s sole and exclusive remedy with respect to any and all claims, causes of action and/or lawsuits relating to or arising out of the Contest and/or use of the Photo shall be an action at law for the recovery of monetary damages only, and in no event shall any of the rights acquired or to be acquired by any of the Khan Academy Parties hereunder be affected or impaired. Each entrant agrees that in no event shall the entrant have the right to enjoin or otherwise interfere with the exercise by any of the Khan Academy Parties of any of their rights hereunder or to terminate or rescind any of the rights granted herein. Non-compliance with the Official Rules may result in disqualification. Any legal proceedings arising out of this Contest or relating to the Official Rules shall be instituted only in the federal or state courts located in the State of California, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules.
 
11) REQUEST FOR WINNER: The winners names will be announced on Khan Academy’s Instagram during the Contest Period.  Individuals may request the names of the winners by submitting a self-addressed stamped envelope prior to December 31, 2018 to Khan Academy, PO Box 1630, Mountain View, CA 94042.  Vermont residents may omit postage.
